Previous company not accepting resignation

I've served the whole notice period of 45 days and on the very last day, manager says that I didn't complete my work and wouldn't be accepting my resignation. It's already been a week since I joined my new firm and they're asking for the resignation acceptance mail/proof. All my email, slack accesses have been revoked from the previous company and manager is still reluctant to let me go in peace. New company has agreed to enter the joining date accordingly in the system once I get the resignation acceptance to avoid any dual employment conflict. Could anybody help me with the legality of this and how I can proceed?

All this needs is a legal intervention, HR folks usually crap their pants if they hear that a notice from the labour department is coming up

Talk to HR. If HR doesn't help try getting into contact with super senior HR or your department head.

Hr is already aware of the situation and is helpless. The guy is the vp and more or less number 2 after the ceo so they spineless in front of him.

Write a Physical Letter to Labour minister and HRD minister with a copy to CEO, Chairman naming and shaming the company, your VP and also the head HR mentioning this. Letter should be sent as a physical copy as well as through EMAIL. Also write to the licensing authority for Zoom Car.

What 3rd rate company is that!! Just go all blast against them. Nobody can force you to keep working if you have given advance notice as per their notice period. File complaint against them on MCA portal, or anywhere else that you can think of. Ask some legal folks too.

Take it to linkedin publicly.. Tag the company and people involved.. I believe nothing will spoil your name on posting this publicly.. This kind of actions shouldn't be encouraged at all..

In these 45 days notice period did you not push for resignation acceptance mail & last working day confirmation? This should be enough for the new employer. After a couple of months you can pursue for Experience Certificate which no employer can deny as per law.

This was my first job so wasn't aware that I needed the confirmation and acceptance from him. Even if I did, I would never have imagined that he'd resort to something so petty.

Most people react emotionally in such situations. Clearly the manager involved in this situation is immature and maybe even vindictive. Did you have any discussion around the time when you resigned as to what was expected from you during the notice period? If you have a record of that in writing then it should be a straight forward discussion. If you don't talk to the manager in the presence of HR and just finish the work if it's something that can be finished in a short time. If the demand is unreasonable then I guess you will not be left with a choice but to take a legal route. But this should be your last resort. Also be sure to keep a record of all communication with them, just in case you go legal it'll be helpful

HR never does anything! You should tell them you’ll take legal action!
