Employment offer letter is a contract with employee and employer. Employer is sending a contract mentioning 90 days of notice and employee is agreeing and signing it. Labor law has nothing to do with contract conditions set by employer and employee in offer unless there is any law violation

There can be regulations by government for a definite notice period.

Because legally its not valid. They would just say employee decided to give 3 month notice. And of course if you don't then they'll make your life hell by not giving experience letter etc etc

Legally it's valid for the fact that it is mentioned in offer letter specifically and employee has signed on the conditions specificied.
