
URGENT ADVICE REQUIRED
I joined Company X on Dec 30, 2024, as a permanent employee. However, on the next day of joining the recruiter informed me that it was actually a 6-months contract based role and it was miscommunicated. By rejecting all other offer and having no choice I have joined the company. I was also told by recruiter that the notice period is 30 days.
Now I have an offer from Company Y, I discussed it with my team lead and he is stating that the notice period is 90 days, even for a contract role. When I mentioned what the recruiter told me, he advised me to check with HR. I have sent my resignation mail and requested an early release. It’s been just 2 months I’ve joined the company and working on contract based.
I’d appreciate any advice on how to handle this notice period negotiation effectively.

If you have worked for only 2 months in this company, why don’t you leave as soon as possible and join the new company? Relieving/service letter won’t make any difference for a 2 months experience.

Are they deducting pf also? If yes then serve notice period and try to reduce it, if they are not deducting pf then better leave bcoz it's just 2 months and u already have the offer so these months won't be counted

In my opinion, check all documents/mails for termination/notice period clause. In the absence of the same, you can leave by giving 30 days (make sure to take a printout or cc yourself of the mail if sending from org's mail).
Also, please check with the new org in which you are joining whether they require any NOC or they will seek an experience certificate or any similar documents.

Does probation mean contract based?


Legally the separation clause needs to be mentioned in the offer letter or in the employee handbook. And you need to have signed off on it. Else you can connect with a local Labour law consultant to help you with what the standard terms for your region are.
