So do we need to return the bonus amount if the company separates the employee after the bench period?

In the offer letter they mentioned only "if you leave the company within the lockin period", so for termination this clause will work?

Yes...even for termination it will work .. recently one of my colleagues got terminated and she was asked to return the bonus amount..

I mean how legal is this even? To ask the bonus back itself is a red flag, people being fired are supposed to be paid severance and the company expects the bonus back 😂 I'm questioning my choice to join here now.

But that's not fair right...if the company is terminating we shouldn't be returning the bonus amount. Is this mentioned in any policy?

yes, but they are clearly not mentioned for termination, I think that's why they are pushing the people for voluntary resignation to retain the bonus!!!

No it must be mentioned. In my offer they have clearly mentioned the joining bonus should be returned if employee separates from the company irrespective of the separation reason. Time limit is 13 months for me personally.

If you inform your HR that you are being terminated so you should get compensation then they will not take your bonus money just to avoid compensation. You have to discuss this with HR first and try to pressurise by telling them again and again if they are not listening. It worked for many of my friends
