I got NI in the last quarter. I am currently on bench. I will go on maternity leave within 2 months. But my manager is checking to prepare for maternity leave early. His suggestion was to take LOP after delivery

I think he is trying to save you from layoff. Your have rights only if you are an employee. If you are On ML they can’t initiate PIp. By that time infy may have relaxed rule you might escape PIP. But if you don’t go on ML you will continue on bench and with NI rating your PIP will be initiated and depending on your goals you may or may not be terminated. I would say none of this is important at the moment and it’s not worth taking any tension. The most important thing is to take care of yourself.So take that ML and let the crisis tide over.

Ok so I can adjust earned leave for one month and remain I can take ML.

Nope take ML from now. Kind of gives you immunity against any action based on performance . And then use your EL and LOP after you exhaust ML. Hopefully by time you are back situation has improved and you can join a project in a fresh appraisal cycle.

No one can fire during maternity so just ignore by saying i will consider or let me discuss with hr about ML policy

@MJ23 Yes, I didn't agree. As per the labour rule, all lady employees rights when they can decide on maternity leave are not forcefully determined by the manager's decision.

Your manager's suggestion is as useful as a chocolate teapot. Maternity leave isn't a vacation, it's a right. "LOP ke naam pe kya naya drama hai?" What's his next brilliant idea?
