Trending @Cognizant; Not paying Night shift allowance

Working in US shift from 4pm to 2am and I am eligible for night shift allowance but higher management saying you have to be in office from 10pm to 1am to get that allowance.....how fair is this?

I am working from 3pm to 1am and going to office 3 days a week, Getting the shift allowance . No such criteria to be in office for till 1am.
