Request for Immediate Intervention Regarding Prolonged Mental Harassment, Illegal LWP Deduction, and Withheld Recovery Payment at TCS

Hello Team,

I would like to formally raise a serious concern regarding the prolonged mental harassment, unethical conduct, and financial loss I have suffered at Tata Consultancy Services (TCS). I am requesting your urgent intervention, as this matter has been ongoing for the last year and continues to remain unresolved despite multiple escalations.

While I was placed on the bench at TCS, a male RMG HR staff member subjected me to continuous mental harassment. He neither allocated any project matching my skills nor made any attempts to place me despite repeated requests. In addition to this, he passed several inappropriate, personal, and humiliating comments about my medical and personal life, causing severe psychological distress.

As a direct result of the harassment I faced, my mental health deteriorated drastically. I went into depression, began undergoing psychiatric treatment, and continue to take prescribed medication even today. My physical health also declined severely — including significant weight loss — which made me unable to attend the office during that period.

Despite the fact that my inability to attend work was entirely due to the mental harassment created by TCS’s internal management, the company unilaterally marked six months (184 days) of LWP leave, causing a major financial loss. According to labour law principles, when an employee is unable to attend work due to harassment, hostile work environment, or mental trauma caused by the employer or its representatives, the company cannot impose LWP or deduct wages. The organization becomes liable to compensate the employee and restore the deducted salary.

It has now been over four months since I officially raised this case, yet my recovery amount has still not been paid, and no corrective action has been taken against the individuals responsible. This delay also constitutes negligence, and those involved in withholding my rightful payment must be held accountable.

Therefore, I request the Work Union / Employee Rights Authority to urgently investigate and take strict and appropriate action in this matter. My demand is straightforward: I must receive the full six months’ salary that was wrongfully deducted, along with appropriate corrective measures against the responsible TCS personnel for creating a hostile work environment and causing severe mental and physical damage.

I expect a strong, time-bound response and intervention, as the company has already delayed the resolution beyond reasonable limits.
