Need Urgent Advice: Resignation& Relieving Issues
Hi everyone, I really need some genuine advice from people who’ve faced similar situations.
I resigned from my company recently. There was no mention of any notice period in my offer letter when I joined. Still, I worked for around 15 days as a handover period. During this time, I developed severe cervical pain and informed my manager that I could only work 5–6 hours a day. On a call, they agreed that I should share my medical certificate and they would release me.
I did mail them my medical certificate, which covered June 2 to June 10. But then they turned around and said: Since you’ll be fine after June 10, your notice period is now extended by 10 more days. I clearly said the certificate is proof of my condition, not a “recovery window.”
Then they demanded I buy out the remaining days. I refused because there was no such buyout clause or policy ever shared with me. Suddenly — after my resignation — they created a so-called “appointment letter” claiming it was missed earlier, with new terms to force the buyout clause.
When I refused to accept this, they said “If you accepted salary, that means you agreed to the appointment letter, even if you didn’t sign it.” I opposed this too, with all facts and proofs.
Now they’re threatening that if I don’t return the laptop within 2 days and don’t pay the buyout in 7 days, they’ll take legal action. Meanwhile, they’re withholding my May salary and my relieving letter.
I told them clearly: If my rightful salary is not credited, I will take legal action too — and of course I’ll return the laptop properly.
👉 My questions for the community: 1️⃣ What should I do if they refuse to give me a relieving letter? Can I still join my next company? 2️⃣ Is it legal for a company to create an appointment letter after resignation and force new terms? 3️⃣ How do I handle this if they don’t pay my pending salary?
Please share your thoughts, similar experiences, or any practical legal advice. I really need help to handle this smartly.
Thank you to everyone who reads and responds — it means a lot!

Here’s a concise action plan for your situation:
Relieving Letter: You can still join your next company by explaining the situation—show email proofs if needed. Many companies understand such conflicts.
Legal Validity: Post-resignation "appointment letters" with new terms are legally questionable—consult a labor lawyer (many offer free first consultations).
Pending Salary: Send a formal legal notice via a lawyer if they withhold salary—this often forces compliance.
