Trending @Infosys; My Colleague is in trouble
Person A got NI ratings from his manager, person A is in major project in Infosys and now built a kind of dependency in the current project, lot of pressure and work load n not getting Variable pay due to NI ratings.
Person A got offer letter from Accenture n put paper, manager got to know that A got offer letter from Accenture and later HR,
Now they are saying as per the policy you r not allowed to join Accenture n TCS n etc
What should person A do now?

There is no way they can do anything from Joining accenture as According to Labour Laws in India no company can force anyone to not join any of their Rival conpanies.... Just put down the papers and join Accenture.

Just tell the manager that he also has an offer from a third company whose name is not there in NDA. How difficult is that?

First of all there is no policy that if you are working in Infosys, you can't join Accenture or TCS. Please check the policy before writing here. The policy is you can't join the same project in other company. That's it. The manager or HR are clearly lying.

This is just a tactics to cowed him. So that he will think of revoking resignation. Ask him to strong don't revoke resignation. Infosys can not take any legal action also hundreds of ex infy joined Accenture and other rivels.
There is only rule which is legally valid only for CEO,CFO,cto like roles that they should not join any form or to be part of any firm for 6months -2yrs after leaving infy. Infy pays them compensation for that duration.

That is a normal tactic from a low level manager . Right of livelihood- no one can stop you from joining any company. Also Infosys is not going to go after you when they have 6lac+ employees. Legal process is much more expensive

First of all how they will get to know where you got offer ? Second even if they know no one can stop to join until you are not joining same project which infy and your next joining company holds . You can search same cases what was the outcome recently happened. If you stay many chances that you will get exploited again . For my suggestion check all options and switch

Absolute BS by the manager. You employee A can go to any company.

You cannot join named competitors (TCS etc) for the same client you have worked for earlier. Nowhere it is written you cannot join them. To tackle this , simply put in the resignation reason as personal and If needed serve three months notice and convince the next company to wait for three months. Legally nobody can force you to work beyond three months notice and after that you are a free bird.
