Yes, it's happening for people who got UP rated (Under performer). But they are getting a clear exit (performance issue will not be highlighted during BGV) and getting 4 months salary. One of my colleague got laid off in a similar way and is working for HCL now. He didn't even have to serve the notice period. BGV stays clear.
