HR asking for early release

Hi All , I have resigned on 5th of September and it was decided and mentioned in the mail that my LWD would be 3rd of December . I then talked with the HR and supervisor over teams chat if I can get an early release - They said NO . I was also ok with it and made up my mind to serve 90 days notice period also mentioned the same thing to my next company HR .

Now the twist is I have given my KT and handed over everything to my back up resource in my project and ended my dependency there . Now I got a call from the HR that I have to take early release . And they are not going to pay for the rest of the days of my notice period . Now I have family dependency.. How can I deal with the situation?

Exactly, the same thing happened to me. I resigned on 30th September at the time of the project onboarding and they initially set my NP as 26th December. But within 2 days they changed my LWD to 13th October and when I asked for NP pay, they denied.

As per the policy they should pay the NP pay , I think .Also what should be the best way to deal ? what did you do ?

I am still thinking about what I can do about this. We can ask the HR one more time. If it doesn't workout then we need to move legally.

If they want, they may initiate an early release before completing the 90-day notice period, without any pay for the remaining notice period days. Please refer to the Separation Policy in the HR Policy Hub on Ultimatix for more details.

Yes , thats true .. they can . But it should have been informed to me earlier . When I put my paper I asked for it as my next employer ask to join early , they cleared sai NO .. And said you have to serve the 90days notice period . NP can't be reduced . so I aligned everything accordingly..My ticket booking to relocate to the new place and etc . Now again they are saying to get released earlier.. This is not professional at all .

Your release has nothing to do with your any of project work NOW basis on the current company situation which is downward. They have cought you in trap of early release with no extra pay that's what they are praying policy. You need to talk to HR and HR manager if on humanitarian (its no more their) ground they can think something financial assistance. Otherwise you have go with the process they decide afterall you are working under them.

I am 20+ years of experience and worked with multiple organisation. The contract between employee and TCS, which both have signed at the start of the employment says, 90 days notice period from both side. TCS can release anytime within the 90 days notice but need to pay for the shortfall of the 90 days. This is a legal contract and any policy (if at all exists, very less probability) will not hold for this. Once your FnF is done and you get your experience letter, send mail to them, keep all the leadership in cc. Then put all these on social media. Take help from NITUES, or any other IT employee union.

U need to talk to HR for this matter .Even they are also helpless nothing u can do because I had signed their policy.No ethics and inhuman behaviour .Do some side business and get earnings

No ethics just profits and business mindset tcs lost it’s charm I wonder who will stay here in the long run

If they want release you early then you cant do anything.Only option you have talk to your next company HR and see if you can join there early.
