How gratuity works in case of merger or acquisition

When a company gets acquired by or merged with TCS and if employee from other company has served 7 years in other company and has served 3 years in TCS, will he/she be eligible for gratuity from TCS? Or should he/she needs to serve another 2 years to get it?
