But as per new labour code employees will get the graduity after 1 year of service, is that infosys not following the new government rules yet.

That rule is only for contract employees

In Infyme, there is a gratuity calculator
There you can put separation date and it will show how much gratuity you will get if you separated on that particular day. It shows 0 if you are not eligible for gratuity on the mentioned date
