Firing Employee with no appropriate reason.

One of my colleague from TCS-USA is unallocated since from December. Yesterday he received a call from HR informing him that it's his last day of work today.

He didn't even received any formal mail about it. I'm also pretty shook from the news.

While being unallocated he did gave few interviews and got selected but due to some unknown reason, the project managers were informed that he is already allocated so they cannot allocate him (Which he found out recently).

WTH! No one is taking responsibility and ruining career in an instant.

HR/RMG is saying "He rejected many opportunities" which is not even matching his expertise.

Is HR/RMG too dumb? I really want to know if they were suddenly asked to switch the roles and be a developer instead!

USA has 2 week notice ...or at someplace that is also not thr... so it's very common .. he must be aware of these details

So, they don't give any prior notice?

This is a good opportunity for him to file a law suit and make 10 million dollars

Doesn't work like that in usa. Firing someone because there is no work for them is common in usa. So many big tech companies have been firing employees every year.

Was he a local hire or Indian sent onsite? Case would be different. Even local employees have sued some of the FAANG names and won.

United States has different labor laws. This happens in all organizations over there.

Is he an expat or USC or GCH. For expats, when you're unallocated, you have 15 days to find a new allocation else you will have to travel back to your home country. This is the norm. The conflict of interest that you mentioned about the project manager happened to me as well. But I wrote an email to HR, copying RMG with the project manager who is unable to allocate due to miscommunication that I was allocated in a different project. So now he has the option to travel back home. If he is USC/GCH, he has to resign that the law.

I think he is a GC Holder, so he has to resign?

But due to internal miscommunication between may be HR/RMG/Project Managers lead to this situation.

Because later he got to know from project managers that they were informed that he is already allocated thats why they couldn't process his allocation. (He already gave interview and got selected. So he was waiting for confirmation.)

There might be a different reason linked to his Visa amendment. Since Trump is coming now, all the companies are trying to be safer from their end

I'm happy to learn something new about policy!
