If A files and FIR against B then that FIR with charges framed against B goes to magistrate and magistrate takes the cognizance of the matter. Summons B and ask if he/she accepts that he committed crime. If B says NO the trial starts where B has to prove himself innocent.

Framing charges and conviction are two different things.
