
Don't force resign just ask them to layoff
Forced Resignation A forced resignation, often referred to as constructive dismissal, occurs when an employer creates an intolerable work environment or applies pressure that leaves the employee with no reasonable option but to resign. The resignation, though seemingly voluntary, is effectively coerced.
A layoff is when an employer terminates employment, usually due to economic reasons, downsizing, restructuring, or a lack of work, and not due to the employee's performance or misconduct. Layoffs can be temporary or permanent.
Benefits for the employee in a layoff:
Severance pay: In many countries, including India, and based on company policy, employees who are laid off are typically eligible for severance pay. In India, under the Industrial Disputes Act, 1947, a workman laid off is entitled to compensation.
Unemployment benefits: Laid-off employees are generally eligible for unemployment benefits, unlike those who resign voluntarily (unless the resignation is proven to be forced/constructive dismissal).
Notice period: Employees are typically entitled to a notice period as per labor laws or their employment contract.
Gratuity and other terminal benefits: Employees in India are generally entitled to gratuity (if they meet the criteria of continuous service), provident fund, and leave encashment upon layoff.
Outplacement services: Some companies offer outplacement services (resume help, job search assistance, counseling) to laid-off employees to help them find new employment.
Reputation: Being laid off generally does not carry the same negative stigma as being fired for cause, as it's understood to be due to company circumstances rather than individual performance.
