Using on-ground news footage, animations, or song segments isn’t inherently transformative unless the original creator/work itself is being critiqued or analyzed. If content is simply enhancing production quality, would ot still be covered under fair use citing length of the clip used? Where do we draw the line?

2️⃣ Is ANI wrong for following predatory practices within a capitalistic system?

The business of ANI is to sell news and content to bureaus. You can't simply use thier content and make money and not pay them. They run a force of on-ground reporters. In the absence of an agency like ANI, the agency which gets access to an important event will eventually make the most profit out of it. I don't see ANIs subscription as extortion. You use their content, you pay them. As simple as that.

Should it fall under free use policy: In both the mentioned cases- No, the clips used are for upgrading the production quality of their own videos.

Real engineering sent an Invoice first time, when he got no response he filed copyright claim and later removed it. Arun blamed it on a new employee which pissed Real Engineering (taking no accountability for his own team and throwing employee under the bus) , so second time he filed copyright claim & refused to take it down

This was completely justified, nothing unethical.

ANI waits a few months and files copyright claims in bulk, definitely predatory and sorta extorting money instead of just taking revenue from the flagged videos.
Isn't that how businesses operate in India though? Where legal system is rigged and instead of going through court for years you just end up paying & settle? Creators can just stop using ANI clips.

Mohak didn't cause any copyright infringement because news clippings cannot be copyrighted in India. ANI legally cannot do anything in this regard.

Under Indian regime legal framework being the Copyright Act, 1957, section 52 lays down certain acts or works that cannot be considered as an infringement of copyright namely fair dealing with a literary, dramatic, musical or artistic work not being a computer program for the purposes of-

fair dealing with any work, not being a computer programme, for the purposes of— (i) “private or personal use, including research; (ii) criticism or review, whether of that work or of any other work; (iii) the reporting of current events and current affairs, including the reporting of a lecture delivered in public.

Does YouTube know ANI who is copyrighting the videos is the original creator of those videos if true then how come like I can share original twitter account if asked but that is different from fake no?. I don't know why but i am thinking someone in the middle is using their name to extort money. Maybe I am wrong I don't know but I never heard bad about ANI before.
