A friend of mine joined TCS and got pregnant within a month.HR and her manager are forcing her to come to office inspite of medical issues.

She had multiple offers but joined TCS because she thought it was an employee friendly company. Her symptoms have worsened recently and doctor have advised to not travel. She requested work from home, but hr and her manager flat out refused. Also they gave her one month LWP without her consent. She is a junior so got intimidated easily. Yesterday she resigned because she thought she has no option, so she resigned. They are telling her that it's against policy to ask for work from home. I know for a fact that they are lying. Also if any other projects are approaching her, they are scaring them away saying she is pregnant and will soon go on maternity leave. I told her to withdraw her resignation and also escalate and email the supervisors of her manager and hr. Need some solid advice about what are her options and what action she can take.

I think an employee should work for some stipulated 3 or 6 months in order to receive maternity leave in an organization. I am not sure about this exception is there any pre-requisite like that

She is not asking for maternity leave. She is asking for work-from-home due to her pregnancy.

In apprsial who ever is mentioned in HR tab is unit HR

I read in policy that you need to complete 82 something days in a company in order to get maternity benefits. But I am not 100% sure please check policy

Tcs provides WFH exception from the day of conception, please check policy document

So she mailed back two days ago,HR stayed silent the whole day after. Sent a callous reply today that her resignation has been processed and it can't be revoked. And since today, without any notice, she is locked out of Ultimatix, her emp id isn't visible any more and she can't log in to her TCS mail. Within 4 days of resignation they stopped her email and ultimatix!

Employee can avail exception during pregnancy even though it was bit difficult to follow up on approval process(HR and manager has to be aligned). I took WFH for 8 months during pregnancy due to my medical condition. It was approved each month after explaining everything with medical documents/doctor notes. So your friend has to speak up and escalate this issue by highlighting the policy to hr head/higher management. Hope she gets what is required and have smooth journey. Also she can't be fired/released during pregnancy. So she can definitely take the chance and avail WFH which she deserves instead of resigning.
